Ms. Kagan argued before the Supreme Court that the law should be read to allow the government to prohibit the publication of political pamphlets. In a nation stirred to its own founding by political pamphlets such as ‘Common Sense’ and ‘The Federalist Papers,’ this is an extremely disturbing position.”

And in a 1996 article in the University of Chicago Law Review titled “Private Speech, Public Purpose: The Role of Governmental Motive in First Amendment Doctrine,” Kagan argued that the government’s motive for banning speech should be “the most important” factor the Court should consider when determining if speech bans or restrictions are constitutional.

The Washington Times again: “We know she deliberately ignored the law while at Harvard, and unfairly besmirched our military in time of war. The facts are simple. A law known as the Solomon Amendment made it illegal to keep military recruiters off of college campuses. … Then-Dean Kagan barred the recruiters from campus anyway, thus flouting the law. … .”

Furthermore, Kagan apparently believes that judges should legislate from the bench.

In her 1983 Oxford University thesis, Kagan spelled out what she believed to be the role of judges by writing: “…as participants in public life, judges will have opinions, prejudices, values. Perhaps most important, judges will have goals. … And because this is so, judges will often try to mold and steer the law in order to promote certain ethical values and achieve certain social ends. Such activity is not necessarily wrong or invalid.”

Tell your Senator that “Somebody who openly flouts the law should not be one of the law’s ultimate arbiters” and you want them to vote no.

Progressives in Congress are trying to sneak cap-and-trade through the Senate.  They passed the energy taxes in the House, but the American people rejected the plan and senators will not support this policy.

Senator Reid announced last week that he will not attempt to pass cap-and-trade before November; instead he wants a so-called “noncontroversial” energy bill.  But desperate times call for desperate measures, Reid is certain to pull out all the tricks to slip cap-and-trade through before he potentially loses control of Congress.

While conservatives are busy celebrating election victories, Reid’s lame duck Senate will try to pass cap-and-trade energy taxes before the new Congress convenes in January 2011.  And we know they will try.
